On the Hill

Infrastructure Stops and Starts Continue
As previously reported, Congress has passed the bipartisan infrastructure package, the Infrastructure Investment and Jobs Act. The package primarily contains investments in traditional infrastructure projects such as roads, bridges, tunnel construction, and general infrastructure repair. While it does not contain any provisions specific to higher education, colleges and universities may want to note that the package includes roughly $65 billion for rural broadband connectivity efforts, new investments in transportation and energy research, and modifications to the employee retention tax credit that will limit its use for wages only through October first of this year.

The future is much less clear for the Democrats’ Build Back Better legislation, which contains numerous higher education provisions. Because of continuing discussions over the cost and content of the bill, and other pressing items on lawmaker agendas, there is speculation that the bill may not be finalized until sometime in December.

Association Action

New NCAA Constitution Proposes Big Changes in College Sports
The National Collegiate Athletic Association (NCAA) has proposed a draft of a new organizational constitution that would significantly alter the management of college athletics. Notable proposals in the draft would: acknowledge the right of student-athletes to be compensated by third parties for use of their name, image and likeness; allow each division the authority to organize itself, and create new divisions or subdivisions within the division; and offer each division authority to determine their own governing structures, membership eligibility metrics, and standards for academic eligibility and revenue sharing. Other notable changes shrink the size of the NCAA Board of Governors and create leadership positions for student-athletes.
