Administrative Action

ED Updates to FAQ on Cybersecurity Compliance. In an update from the senior advisor for cybersecurity, Federal Student Aid, to the Cybersecurity Compliance Frequently Asked Questions (FAQ), the Department of Education (ED) is reminding institutions that the Student Aid Internet Gateway (SAIG) Agreement requires that institutions “report actual data breaches, as well as suspected data breaches on the day that a data breach is detected or even suspected.” Further, ED, “has the authority to fine institutions—up to $54,789 per violation per 34 C.F.R. § 36.2—that do not comply with the requirement to self-report data breaches.” The FAQ also reminds institutions that starting in FY18, they will be audited on securing student information.

Judicial Action

Legal Challenges to Net Neutrality Repeal Ramp Up. Litigation challenging the recently passed Federal Communications Commission (FCC)  order that pulls back Obama administration net neutrality protections has begun. Attorneys general from 21 states and the District of Columbia have filed suit to block the new rules, as have various public interest groups. Congressional Democrats have also stated that they intend to push forward a vote for a simple repeal of the FCC’s order under the Congressional Review Act within the next few months.   

Awaiting Action

1098-T Reporting. The  IRS has not yet issued final regulations on 1098-T reporting following its Notice of Proposed Rulemaking that calls for significant reporting changes to the form. NACUBO posted a detailed Q&A document in response to issues raised during original broadcast.
