Higher education endowments and affiliated foundations achieved an average investment return of 15.8 percent in FY14, according to preliminary data from the 2014 NACUBO-Commonfund Study of Endowments® (NCSE). This compares with an average return of 11.7 percent reported by study participants in FY13.

IRS Expands Guidance on Private Business Use of Bond-Financed Facilities

Notice 2014-67 expands previous IRS guidance addressing possible private business use from management contracts, creating a new safe harbor that is immediately available for any governmental or qualified 501(c)(3) bond issue.

ED Scales Back Accountability Measures in Gainful Employment Rule

A program-level default rate metric, originally included in the Department of Education’s proposed rules, was stripped in the final version, leaving only a debt-to-earnings measure to determine eligibility for programs that prepare students for gainful employment in a recognized occupation.

ED Publishes Final Rules on PLUS Loans

After a quick comment period, the Department of Education has issued final rules administering its Direct PLUS Loan program, specifically addressing the definition of “adverse credit” and its impact on loan eligibility. While effective July 1, 2015, ED has identified these rules for early implementation.
