Overview
Attorney Chad Echols will lead the discussion in this post-conference workshop focusing on the legal aspects of collections. Echols, one of NACUBO's highest rated speakers, will address bankruptcy issues, collections, and creditor and collector liabilities. Several case studies will be reviewed, and attendees will be provided with key takeaways, including examples of contract language and provisions, which can be used to assist in everyday activities to help strengthen their institutions' ability to recover defaulted obligations.

1:00 pm - 2:15 pm Creditor and Collector Liabilities
The collection industry has never been more litigious. Statutory changes, the regulatory environment, and consumer attorneys using the internet to locate clients have all lead to an enormous increase in industry litigation. This session will discuss the most pressing liabilities facing the collection industry and how creditors can assist in limiting your partnering agencies' liabilities. Additionally, more statutes and regulations are shifting liability directly to creditors when first party collection attempts are made. Keep your liability low by addressing risks you might not even know you have.
2:15 pm - 3:30 pm Bankruptcy
A student has filed for bankruptcy protection! What do you do? This session will walk you through all of the issues that may arise. We'll focus on the legal definition of "student loan" for purposes of receiving a discharge and discuss what actions a school can or cannot do to protect its debt from discharge. Also, this session will provide an overview of the various ways that a bankruptcy filing can influence an institution's collection efforts. Several case studies will also be shared to help illustrate the law in this area.

3:45 pm - 5:00 pm Financial Services Toolkit
Walk away with concrete examples of contract language and other information to help put your institution in the strongest legal position possible with respect to student receivables. This session will address a myriad of contract provisions, their legal meaning, and how their use can strengthen institutions' ability to recover defaulted obligations.
