Expedited Processing of Certain H-1B Visa Applications Resumes

Expedited processing for certain cap-exempt H-1B petitions resumed on July 24, according to an announcement from U.S. Citizenship and Immigration Services (USCIS). Earlier this year, a temporary hold had been placed on the fast-track processing of H-1B visas, in order to address a backlog of unprocessed applications. 

Premium processing will resume for petitions if the H-1B petitioner is one of the following:

  • An institution of higher education.
  • A nonprofit organization affiliated with a higher education institution.
  • A nonprofit research or governmental research organization.

According to the recent USCIS announcement, petitioners who are eligible for premium processing—such as colleges and universities—can now file Form I-907, Request for Premium Processing Service for Form I-129, Petition for a Nonimmigrant Worker. Form I-907 can be filed together with an H-1B petition or separately for a pending H-1B petition.
